Southend Selective Licensing Expansion: Is Your Rental Property Compliant?

Southend Selective Licensing Expansion: Is Your Rental Property Compliant?

Southend-on-Sea City Council has opened a consultation on a new selective licensing scheme. If approved, it would cover more of the city’s private rented sector. Landlords should start preparing now. A licence application is much simpler when the property’s compliance certificates are already current, valid and ready to submit.

What Southend Council Is Proposing

The current scheme started on 1 December 2021. It covers designated neighbourhoods in the Milton, Kursaal, Victoria and Chalkwell wards. The new proposal keeps parts of all four wards and adds neighbourhoods that were not covered before. The proposed area contains around 5,685 privately rented households, which is 51% of all households in the designated area.

The council’s independent evaluation found that by August 2025:

  • 4,394 licences had been issued
  • 1,896 properties had received initial compliance inspections
  • 1,689 housing hazards had been identified, none of which tenants had previously reported to the council
  • 138 formal enforcement interventions had been carried out

The consultation closes on 31 December 2026. The council is working towards implementation from 1 April 2027. It has also said there will be a gap between the end of the current scheme and the start of any replacement.

Why Compliance Certificates Matter for Your Licence Application

Selective licensing is designed to raise standards across the private rented sector. When you apply for a property licence, local authorities normally expect proof that the property meets its statutory safety and energy obligations. Under the Housing Act 2004, licences also carry mandatory conditions that require landlords to produce certain safety documentation on demand.

For most rental properties, the three key documents are:

1. Energy Performance Certificate (EPC)

Under the Minimum Energy Efficiency Standards (MEES), a privately rented home in England and Wales must have a valid EPC rated E or above, unless a valid exemption is registered. An EPC lasts 10 years. However, an older certificate may not reflect improvements made since, and it may leave you exposed if the rating is borderline.

2. Gas Safety Certificate (CP12)

Under the Gas Safety (Installation and Use) Regulations 1998, every gas appliance, fitting and flue in a rental property must be checked every 12 months by a Gas Safe registered engineer. Tenants must receive a copy of the record.

3. Electrical Installation Condition Report (EICR)

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require landlords to have the fixed electrical installation inspected and tested by a qualified person at least every five years. The report must be given to tenants and to the local authority on request.

If any of these documents is missing, out of date or unsatisfactory, your licence application may be delayed. You could also face enforcement action or financial penalties.

The Cost of Getting It Wrong

Operating an unlicensed property in a designated area is a criminal offence. It can lead to an unlimited fine or a civil penalty, and tenants may be able to claim a Rent Repayment Order. Separately, councils can enforce breaches of the EPC, gas safety and electrical safety regulations with their own penalties. With enforcement activity increasing in Southend, landlords should not leave compliance to the last minute.
